Please read these terms carefully before using the Kamal Housing platform. They define the rules and regulations for your use of our services.

Service Agreement
By using our platform, you agree to these terms governing your access and use of Kamal Housing services.
User Responsibilities
Users must provide accurate information, maintain account security, and use the platform responsibly.
Payment Terms
Society subscriptions and resident payments are governed by transparent billing and refund policies.
Dispute Resolution
Any disputes are handled through mediation first, followed by arbitration under Indian law.
1. Acceptance of Terms
Agreement to Terms
By accessing or using the Kamal Housing platform, including our website, mobile applications, guard devices, and any associated services (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our Services.
Authority to Bind
If you are using our Services on behalf of a housing society, cooperative, or other residential community organization, you represent and warrant that you have the authority to bind that organization to these Terms. The organization agrees to be bound by these Terms.
Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or notification through the platform. Your continued use of the Services after changes constitutes acceptance of the modified Terms.
2. Description of Services
Platform Overview
Kamal Housing provides a comprehensive society management platform that includes gate management, visitor tracking, billing and accounting, amenity booking, complaint management, community communication, vehicle management, and related services.
Service Availability
While we strive for 99.9% uptime, we do not guarantee uninterrupted or error-free operation. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice of planned maintenance.
Feature Updates
We continuously improve our platform and may add, modify, or remove features at our discretion. Significant feature changes that affect your workflow will be communicated in advance. We will make reasonable efforts to ensure backward compatibility.
3. User Accounts & Registration
Account Creation
To use our Services, you must create an account with accurate, current, and complete information. Society administrators are responsible for verifying resident information before granting access. Each user must maintain a unique account.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must immediately notify us of any unauthorized use or security breach. We are not liable for losses from unauthorized account access.
Account Types
Our platform supports multiple account types including Owner, Manager, Committee Member, Resident, Tenant, and Security Guard. Each type has specific permissions and access levels as configured by your society's administrators.
Account Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or upon request from your society's authorized administrator. Society-level termination follows the process outlined in the applicable service agreement.
4. Payments & Billing
Society Subscription
Housing societies subscribe to our Services under plans that may be billed monthly, quarterly, or annually. Pricing is based on the number of units and selected features. All prices are exclusive of applicable taxes (GST) unless stated otherwise.
Resident Payments
Maintenance charges, amenity fees, and other society-related payments processed through our platform are between residents and their housing society. Kamal Housing acts as a payment facilitator and is not a party to these transactions.
Payment Processing
Payments are processed through our authorized payment gateway partners (Razorpay, Cashfree, and others). By making a payment, you also agree to the payment processor's terms of service. Transaction fees may apply as specified in your society's plan.
Refunds
Society subscription refunds are handled on a case-by-case basis and must be requested within 30 days of billing. Resident payment refunds for society charges are managed by the society's committee. Amenity booking cancellation refunds follow the society's configured policy.
Late Payments
Overdue society subscriptions may result in service limitations or suspension after a 15-day grace period and written notice. Interest on late resident payments is calculated as configured by the society's committee within the platform.
5. Acceptable Use & Conduct
Permitted Use
You may use our Services only for lawful purposes related to managing or residing in a housing society. You must use the platform in accordance with all applicable local, state, and national laws and regulations.
Prohibited Conduct
You must not: (a) use the Services for any illegal purpose; (b) impersonate any person or entity; (c) interfere with or disrupt the Services; (d) attempt to gain unauthorized access to any systems; (e) upload malicious software; (f) harass, abuse, or threaten other users; (g) use automated systems to access the Services without permission; (h) share confidential society information outside the platform.
Content Standards
User-generated content (forum posts, complaints, marketplace listings) must not contain offensive, defamatory, obscene, or illegal material. We reserve the right to remove content that violates these standards and take appropriate action against violating accounts.
Guard Device Usage
Guard devices provided by Kamal Housing remain our property and must be used solely for their intended security purposes. Misuse, damage, or loss of devices may result in replacement charges as outlined in your society's service agreement.
6. Intellectual Property
Our Rights
The Kamal Housing platform, including all software, designs, logos, trademarks, content, and documentation, is our intellectual property or that of our licensors. These Terms do not grant you any ownership rights in our intellectual property.
Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use our Services in accordance with these Terms. This license does not include the right to copy, modify, distribute, sell, or reverse-engineer any part of our platform.
Your Content
You retain ownership of content you submit to the platform. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content as necessary to provide our Services.
Feedback
If you provide suggestions, ideas, or feedback about our Services, we may use them without any obligation to you. By submitting feedback, you grant us a perpetual, irrevocable license to use and incorporate such feedback.
7. Data & Privacy
Privacy Policy
Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our Services, you consent to the data practices described in our Privacy Policy.
Data Ownership
Society data (resident records, financial data, visitor logs) belongs to the respective housing society. Upon termination, societies may request export of their data in standard formats. We will retain data as required by law.
Data Processing
We process data on behalf of housing societies as a data processor. Societies are the data controllers and are responsible for ensuring they have proper consent from residents for data collection through our platform.
8. Limitation of Liability
Service Disclaimer
Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
Limitation
To the maximum extent permitted by law, Kamal Housing's total liability for any claims arising from or related to these Terms or the Services shall not exceed the amount paid by your society for the Services in the 12 months preceding the claim.
Exclusions
We are not liable for: (a) indirect, incidental, special, or consequential damages; (b) loss of data, profits, or business opportunities; (c) actions or omissions of third-party service providers; (d) security incidents beyond our reasonable control; (e) decisions made by society committees using our platform.
Security Disclaimer
While our platform facilitates security management, we are not a security agency. We do not guarantee the prevention of unauthorized entry, theft, or other security incidents. Societies remain responsible for their physical security arrangements.
9. Indemnification
Your Obligation
You agree to indemnify, defend, and hold harmless Kamal Housing, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Services; (b) violation of these Terms; (c) violation of any third-party rights; (d) any content you submit through the platform.
10. Termination
By You
Societies may terminate their subscription by providing 30 days written notice. Individual users may deactivate their accounts at any time through the app or by contacting support. Termination does not relieve outstanding payment obligations.
By Us
We may terminate or suspend access to our Services immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. We may also terminate services due to non-payment after the grace period.
Effect of Termination
Upon termination, your right to use the Services ceases immediately. We will provide a 30-day window for societies to export their data. After this period, data will be deleted in accordance with our Privacy Policy and applicable legal requirements.
11. Governing Law & Disputes
Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction.
Dispute Resolution
Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation for 30 days. If unresolved, disputes shall be settled through binding arbitration in Mumbai under the Arbitration and Conciliation Act, 1996.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.
12. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy and any society-specific service agreements, constitute the entire agreement between you and Kamal Housing regarding the Services.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Force Majeure
We shall not be liable for any failure to perform due to events beyond our reasonable control, including natural disasters, pandemics, government actions, internet disruptions, or other force majeure events.

Important Notice
These Terms and Conditions constitute a legally binding agreement between you and Kamal Housing Pvt. Ltd. By creating an account or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accepting on behalf of a housing society or organization, you confirm that you have the authority to do so. We recommend saving or printing a copy of these Terms for your records.
